These terms govern your use of Mercador, including our AI-powered shopping assistant, affiliate shopping experiences, and any purchases processed directly by Mercador.
Platform description
Mercador is an AI-powered shopping assistant for fashion and beauty. We help users discover products through personalisation, colour analysis, and conversational recommendation flows. Some recommendations link to third-party retailers through affiliate relationships, while some products may be sold directly through Mercador.
Accounts and access
You may need an account to access some features. You are responsible for keeping your login details secure and for ensuring that information you provide is accurate and current. We may suspend or limit access where required for security, misuse prevention, or legal compliance.
Product listings and availability
Mercador aggregates and presents product information from partner retailers and internal catalogs. Prices, stock levels, images, availability, shipping details, and promotional terms may change without notice and may not always reflect the current retailer checkout experience.
Affiliate purchases
When you click through to a retailer to complete a purchase, that transaction is governed by the retailer's own terms, policies, shipping rules, and returns process. Mercador is not the merchant of record for those purchases, even if we helped surface or personalise the recommendation.
Owned inventory purchases
Where Mercador sells an item directly, the transaction is governed by these terms, together with the pricing and checkout details shown at the time of purchase. Payments for these orders may be processed using Stripe or another authorised payment provider.
Intellectual property
Mercador, its branding, content, interface design, and underlying software are owned by or licensed to DevTek Pty Ltd. You may not copy, reverse engineer, republish, or commercially exploit the service except where permitted by law.
Liability and disclaimers
Mercador is provided on an as-available basis. To the maximum extent permitted by law, we do not guarantee uninterrupted access, absolute accuracy of product information, or suitability of any recommendation for your personal needs. Our liability is limited to the extent permitted by applicable law.
Governing law
These terms are governed by the laws of New South Wales, Australia. Any disputes are subject to the applicable courts of New South Wales, unless local consumer law requires otherwise.
